Special Agent: Where to place the blame for detention centers being filled
Written by Michael W. Cutler, Senior Special Agent, INS (Ret.)
On July 2, 2019 the Office of the Inspector General (OIG) issued a report: Management Alert – DHS Needs to Address Dangerous Overcrowding and Prolonged Detention of Children and Adults in the Rio Grande Valley (Redacted).
The have Democrats jumped all over the report and pointed their fingers at the Trump administration for mistreating the “migrants.”
These illegal aliens are also referred to as “Asylum Seekers.”
In reality, they are illegal aliens.
The complaints of the Democrats remind me of the classic example of “Chutzpah”- the young man who kills both of his parents and then, upon conviction, pleads for mercy on the grounds that he is an orphan!
The overcrowded conditions of the CBP (Customs and Border Protection) detention facilities are directly related to the massive influx of hundreds of thousands of illegal aliens who have flooded across the U.S./Mexican border in much publicized caravans and in smaller groups as well the Democrats and some of the Republican brethren enticed to come to the United States in unprecedented numbers.
In essence the Democrats threw a party and invited the world to attend. Now that their “guests” are here, the Democrats blame the Trump administration for not having the facilities to properly care for them.
The Congress has also consistently refused to fund the construction of a border wall or increasing law enforcement resources to deter aliens from running our borders or otherwise violating our laws.
There is no shortage of desperate people living in horrific conditions around the world. The political “leaders” of the United States have publicly insisted that illegal aliens must be provided with free education, free healthcare and housing subsidies. The mayors of “Sanctuary Cities” and the governors of “Sanctuary States” openly express their disdain and, indeed, open hostility towards immigration law enforcement officers and have called for the dismantling of ICE (Immigration and Customs Enforcement).
These jurisdictions refuse to cooperate with immigration law enforcement, frequently refusing to cooperate even when illegal aliens are accused and/or convicted of committing violent felonies. All too often these aliens who should have been deported (removed) from the United States, are set free- free to kill and rape still more victims, making it clear that for the politicians, the demands of illegal aliens far and away eclipse national security, public safety and our laws.
Adding to this madness, over the years, several attempts have been made to enact Comprehensive Immigration Reform which would provide lawful status to unknown millions of illegal aliens who entered the United States without inspection. There would be no way to interview these aliens, let alone conduct field investigations to determine if the information contained in those applications are truthful or fraudulent.
Once again the Democrats and some Republicans are claiming that the “fix” to the “broken” immigration system is to enact Comprehensive Immigration Reform that would require the beleaguered adjudicators at USCIS (United States Citizenship and Immigration Services) add unknown millions of applications for lawful status to the more than six million applications they adjudicate annually.
I addressed the ill-conceived notion of Comprehensive Immigration Reform more than a decade ago in my June 22, 2007 Op-Ed for the Washington Times, Immigration bill a ‘No Go’ that focused on my concerns about how this would undermine national security and public safety. In my piece I suggested that Comprehensive Immigration Reform should be given a new and more descriptive and honest title, “The Terrorist Assistance and Facilitation Act!”
The official report, 9/11 and Terrorist Travel included this paragraph:
“Terrorists in the 1990s, as well as the September 11 hijackers, needed to find a way to stay in or embed themselves in the United States if their operational plans were to come to fruition. As already discussed, this could be accomplished legally by marrying an American citizen, achieving temporary worker status, or applying for asylum after entering. In many cases, the act of filing for an immigration benefit sufficed to permit the alien to remain in the country until the petition was adjudicated. Terrorists were free to conduct surveillance, coordinate operations, obtain and receive funding, go to school and learn English, make contacts in the United States, acquire necessary materials, and execute an attack.”
Then-Senator Jeff Sessions quoted from my commentary, on three separate dates, from the floor of the U.S. during the contentious floor debates in 2007 and the legislation was voted down.
What I said then certainly applies today.
The solution to massive numbers of people violating the law is to ramp up enforcement efforts, not eliminate enforcement altogether.
