The Senate confirmed President Trump’s nominee for the 9th Circuit Court of Appeals on Tuesday despite objections from both home-state senators.

Senators split in a 53-45 vote along party lines to confirm Daniel Bress as a judge to the San Francisco-based appeals court. Sen. Kirsten Gillibrand (D-N.Y.) and Sen. Bernie Sanders (I-Vt.), both of whom are running for president, didn’t vote.

Republicans have come under fierce scrutiny for moving Bress’s nomination even though neither Sen. Dianne Feinstein (D-Calif.) nor Sen. Kamala Harris (D-Calif.) returned a blue slip on his nomination.

Harris blasted the confirmation in a Twitter post on Tuesday, saying, “The Senate just confirmed Daniel Bress’s nomination to a California seat on the Ninth Circuit, despite opposition from both home-state senators. Make no mistake: this is a degradation of Senate institutional norms at the hands of Republican leaders. I voted NO.”

Feinstein slammed the move as well, tweeting, “I’m very disappointed the Daniel Bress nomination is moving forward to fill a California seat on the Ninth Circuit. Both @SenKamalaHarris and I objected to his lack of connections to our state. He’s not the right nominee for this lifetime position.”

    My question is why can CALIFORNIA Senators “block” a 9th circuit court appointment, when there are, what, 12 or more other states under the jurisdiction? Don’t the other Senators have any say in it?
